The rich case law of the CJEU and the ECtHR on data retention have raised it into an issue of great importance for the EU regulation and policy making. However, data retention transgresses beyond the narrow borders of the European Union. The US for instance established an obligation of data retention, which was later abolished, giving broader access to Law Enforcement Authorities (LEAs) on data gathered by communications providers. The differences in the approach to data retention do not only reveal a different way of recognising fundamental rights of individuals, but also create a complicated regime for companies with international activity.
This book will engage with the rich case law of the CJEU and the ECtHR on data retention and national security; it will focus on the demystification of the (sometimes conflicting) requirements established by the CJEU and will attempt to provide a comprehensive analysis of the existing safeguards for the respect of the rights to privacy and data protection in this context. It will further engage in the analysis of the situation in legal regimes outside the European Union and the future of a global policy on data retention that would allow for international coherence in the approach towards data retention, the limits of LEAs and the rights of customers and users.
This book aims at answering the research question: “how has the invalidated Data Retention Directive impacted the law and policy of data retention and accessibility for law enforcement purposes and for national security?” and will provide a thorough analysis of the Data Retention Directive and the jurisprudence of the CJEU and the ECtHR. It will focus on the challenges that European and international communications providers face when requested to retain data for law enforcement and will provide novel approaches to the regulation of data retention in Europe and beyond.
